Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Active Budget application, website, and related services (collectively, the "Service") provided by Active Budget ("we," "our," or "us"). The Service integrates with third-party providers, including Stripe, Inc. ("Stripe") for payment processing and Google LLC ("Google") for AI-powered features through the Google Gemini API. By creating an account or using the Service, you agree to be bound by these Terms, as well as the applicable terms and policies of our third-party providers. If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a household or family (e.g., under a Family plan), you represent that you have the authority to bind the members of that household to these Terms. The Service is intended for personal, non-commercial financial management only.
2. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your password secure and confidential, and not share your credentials with any third party.
- Notify us immediately at support@activebudget.app of any unauthorized use of your account or any security breach.
- Accept responsibility for all activity that occurs under your account, whether or not authorized by you.
We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if we reasonably suspect fraudulent or unauthorized activity.
3. Description of Service
Active Budget is a personal budgeting and expense tracking application that allows users to:
- Create and manage budget categories and spending limits.
- Track expenses manually.
- Set and monitor savings goals.
- Receive spending reports and bill reminders.
- Access financial insights and analytics based on your data.
- Receive AI-powered financial guidance, categorization suggestions, and natural-language insights generated through Google Gemini.
The Service is designed for personal financial management purposes only. Active Budget is not a financial advisor, bank, broker, credit counselor, or investment platform. We do not provide financial, investment, tax, or legal advice. Any information, insights, categorizations, or projections provided through the Service are for informational purposes only and should not be relied upon as professional financial guidance. You should consult a qualified financial professional before making financial decisions.
4. Payment Processing via Stripe
4.1 Payment Processing
All payments for paid subscription plans are processed by Stripe. When you provide payment information, it is transmitted directly to Stripe's PCI DSS Level 1-certified infrastructure. Active Budget does not receive, process, or store your full payment card number, CVC, or other sensitive card data. We receive only a truncated card identifier (last four digits), card brand, expiration date, and a tokenized reference to your payment method.
By providing your payment information, you agree to Stripe's Services Agreement and Privacy Policy as they apply to the processing of your payment. You authorize Stripe to charge your designated payment method for all fees incurred in connection with your subscription.
4.2 Subscription Plans and Billing
Active Budget offers both free and paid subscription plans. Features available to you depend on your subscription tier. Current plans and pricing are described on our pricing page.
- Recurring Billing: Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize Stripe to charge your payment method at the beginning of each billing cycle.
- Currency: All fees are quoted and charged in U.S. dollars unless otherwise stated. Your bank or card issuer may apply additional fees for currency conversion or cross-border transactions.
- Failed Payments: If a payment fails, we may attempt to charge your payment method again. If payment cannot be collected after reasonable attempts, we may suspend or downgrade your account.
- Taxes: Fees may be exclusive of applicable taxes (such as sales tax or VAT). You are responsible for paying any applicable taxes assessed by your jurisdiction.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will continue to have access to paid features until then. Your account will revert to the Free plan after the billing period ends.
We do not provide refunds for partial billing periods, except as required by applicable law. If you believe you have been charged in error, contact us at support@activebudget.app within 30 days of the charge, and we will investigate and resolve the issue.
4.4 Price Changes
We reserve the right to change our pricing at any time. If we increase the price of your current plan, we will notify you by email and/or in-app notification at least 30 days before the new price takes effect. If you do not agree to the new pricing, you may cancel your subscription before the new price applies. Continued use of the paid Service after a price change constitutes acceptance of the new pricing.
4.5 Stripe's Role
Stripe acts as an independent payment processor and data controller for the payment data it collects. Active Budget is not responsible for Stripe's handling of your payment information beyond what is described in these Terms and our Privacy Policy. Disputes related to Stripe's processing of your payment data should be directed to Stripe in accordance with Stripe's Services Agreement.
5. AI-Powered Features via Google Gemini
5.1 Use of Google Gemini
The Service uses the Google Gemini API to provide AI-powered features, including but not limited to financial insights, spending analysis, budget recommendations, transaction categorization, and natural-language responses to your financial questions. When you interact with these AI-powered features, certain data — including your prompts, financial context, and related account information — is transmitted to Google's servers for processing.
5.2 Data Shared with Google
When you use AI-powered features, the following types of information may be sent to Google through the Gemini API:
- Your prompts, questions, and instructions to the AI features.
- Financial data necessary to generate relevant responses (e.g., transaction summaries, budget categories, spending patterns).
- Contextual information needed to provide accurate insights.
We do not send your bank login credentials, full account numbers, or payment card information to Google. Data shared with Google is limited to what is necessary to power the AI features of the Service.
5.3 How Google Processes Your Data
Data sent to the Google Gemini API is processed in accordance with the Google Gemini API Additional Terms of Service and the Google Privacy Policy. Key points to be aware of:
- Data Processing: Google processes prompts and responses to generate AI outputs. Google retains data for a limited period to detect abuse and ensure compliance with its policies.
- Model Training: Google does not use your prompts or responses to train or improve its models. Data is processed under Google's Data Processing Addendum, with Google acting as a data processor.
- Data Storage: Data sent to Google may be stored transiently or cached in any country where Google or its agents maintain facilities.
We use commercially reasonable efforts to minimize the amount of personal or sensitive financial data sent to Google. However, the nature of AI-powered features requires transmitting some user data to Google for processing.
5.4 AI Output Disclaimer
AI-powered features are provided for informational purposes only. Content generated by Google Gemini may be inaccurate, incomplete, or outdated. You should:
- Not rely on AI-generated content as financial, investment, tax, or legal advice.
- Independently verify any AI-generated information before making financial decisions.
- Understand that AI-generated outputs reflect algorithmic predictions, not professional judgment.
Active Budget does not guarantee the accuracy, completeness, or reliability of any content generated by Google Gemini. We are not liable for any decisions made or actions taken based on AI-generated outputs.
5.5 Age Restriction for AI Features
In accordance with the Google Gemini API terms, AI-powered features of the Service are not available to individuals under the age of 18. This aligns with the general eligibility requirements in Section 1 of these Terms.
6. Your Data and Privacy
6.1 Privacy Policy
Your use of the Service is governed by our Privacy Policy, which describes how we and our third-party partners (including Stripe and Google) collect, use, share, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.
6.2 Your Consent to Third-Party Data Processing
By using the Service, you acknowledge and consent to the following:
- Stripe: If you subscribe to a paid plan, Stripe will collect and process your payment data in accordance with the Stripe Privacy Policy. Stripe may use cookies and device data for fraud prevention, including on pages beyond the checkout page.
- Google (Gemini AI): If you use AI-powered features, Google will process your prompts and related data in accordance with the Gemini API Terms of Service and the Google Privacy Policy. See Section 5 for full details.
6.3 Data Portability
You may export your financial data (budgets, transactions, categories, and savings goals) from the Service at any time through the data export feature in your account settings. Exports are provided in standard formats (e.g., CSV).
6.4 Data Deletion
You may delete your account and request deletion of your data at any time through account settings or by contacting privacy@activebudget.app. Account deletion:
- Removes your Active Budget account and associated data within 30 days.
- Cancels any active subscription (no refund for the remaining billing period).
- Does not automatically delete data held by Stripe or Google. To manage data held by these providers, contact them directly.
- Certain data may be retained as required by law (e.g., billing records for tax purposes, data subject to legal hold).
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Use the Service for commercial, business, or professional accounting purposes. The Service is intended for personal financial management only.
- Provide false, inaccurate, or misleading information to the Service or Stripe.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems, or to the systems of Stripe or Google.
- Interfere with or disrupt the Service, or the servers, networks, or infrastructure connected to the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service.
- Use automated means (bots, scrapers, crawlers, etc.) to access or interact with the Service without our written consent.
- Sell, rent, lease, or disclose financial data obtained through the Service to any third party.
- Use the Service in a manner that could damage, disable, overburden, or impair the Service.
- Upload viruses, malware, or other harmful code.
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
- Circumvent, disable, or otherwise interfere with security-related features of the Service.
- Attempt to bypass, circumvent, or manipulate the AI safety features, content filters, or usage restrictions of the Google Gemini integration.
- Use AI-powered features to generate content that violates Google's Prohibited Use Policy for generative AI.
8. Data Security Obligations
We maintain commercially reasonable administrative, technical, and physical safeguards to protect your data, as described in our Privacy Policy. You acknowledge that you also have a responsibility to protect your account:
- Use a strong, unique password for your Active Budget account.
- Enable multi-factor authentication if available.
- Do not share your account credentials with others.
- Notify us immediately at support@activebudget.app if you suspect unauthorized access to your account.
- Keep the devices you use to access the Service secure and up to date.
We comply with the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule and Payment Card Industry Data Security Standard (PCI DSS) requirements as applicable to our role in the Service. For payment card security, we rely on Stripe's PCI DSS Level 1 certification, and we maintain our own security controls for data stored within the Service.
9. Intellectual Property
The Service and its original content, features, and functionality — including but not limited to text, graphics, logos, icons, software, and design — are owned by Active Budget and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of any personal data and financial information you input into or retrieve through the Service. By using the Service, you grant us a limited, non-exclusive, revocable license to use your data solely for the purpose of providing and improving the Service.
Stripe, Google, and their respective logos, trademarks, and service marks are the property of Stripe, Inc. and Google LLC, respectively. Their use in the Service does not imply endorsement by or affiliation with Active Budget beyond the integration relationships described herein.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, timely, secure, or error-free.
- Payment processing through Stripe will be uninterrupted or error-free.
- Any financial calculations, categorizations, insights, or projections provided by the Service will be accurate or reliable.
- AI-generated content provided through Google Gemini will be accurate, complete, current, or free from errors or bias. AI outputs are generated by machine learning models and may contain inaccuracies or hallucinations.
- The Service will meet your specific requirements or expectations.
- Defects in the Service will be corrected in any particular timeframe.
YOU ARE SOLELY RESPONSIBLE FOR ANY FINANCIAL DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE, INCLUDING AI-GENERATED INSIGHTS AND RECOMMENDATIONS. ACTIVE BUDGET IS NOT LIABLE FOR ANY FINANCIAL LOSSES, MISSED PAYMENTS, OVERDRAFTS, FEES, OR OTHER DAMAGES RESULTING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR ITS AI-POWERED FEATURES.
We disclaim all responsibility for the acts, omissions, or failures of third-party providers, including Stripe, Google, and any card network (Visa, Mastercard, American Express, Discover). Issues related to payment processing should be resolved with Stripe. Issues related to AI-generated content are subject to the disclaimers in Google's Gemini API Terms of Service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACTIVE BUDGET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill.
- Financial losses resulting from inaccurate data, delayed transactions, or errors in the Service.
- Losses arising from unauthorized access to your account due to your failure to protect your credentials.
- Losses arising from the acts or omissions of Stripe, Google, or any other third party.
- Losses arising from interruptions in the Service, including interruptions caused by third-party service providers.
- Losses arising from decisions made based on AI-generated content, including inaccurate or incomplete information produced by Google Gemini.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless Active Budget and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including those of Stripe or Google.
- Your provision of inaccurate information to the Service or Stripe.
- Any claim arising from your financial decisions based on information provided by the Service, including AI-generated content.
13. Third-Party Services and Links
The Service integrates with and relies upon third-party services, including:
- Stripe: For payment processing. Stripe's services are governed by the Stripe Services Agreement and Stripe Privacy Policy.
- Google (Gemini API): For AI-powered financial insights and natural-language features. Google's services are governed by the Gemini API Additional Terms of Service, the Google Terms of Service, and the Google Privacy Policy.
Your use of these third-party services is subject to their respective terms and policies in addition to these Terms. We are not responsible for the content, privacy practices, or availability of third-party services. We do not control and are not liable for any damage or loss caused by your use of third-party services.
The Service may contain links to third-party websites. We do not endorse and are not responsible for the content or practices of any linked third-party website.
14. Termination
14.1 Termination by You
You may terminate your account at any time by deleting it through account settings or by contacting support@activebudget.app. Termination cancels your subscription (effective at the end of the current billing period) and initiates deletion of your data as described in Section 7.4.
14.2 Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice, if:
- You breach these Terms.
- We are required to do so by law or regulation.
- We reasonably believe your account is involved in fraudulent or unauthorized activity.
- Providing the Service to you would violate applicable law or the rules of any card network, financial institution, or third-party provider.
- We discontinue the Service (with reasonable notice).
14.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 9 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law). Termination does not relieve you of any payment obligations incurred before termination.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the English language.
CLASS ACTION WAIVER: You agree that any arbitration or proceeding shall be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Disputes related specifically to Stripe's processing of your payment data are subject to Stripe's dispute resolution provisions in the Stripe Services Agreement.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page with a revised "Last updated" date.
- Sending you an email notification for material changes.
- Displaying an in-app notice if the change affects your use of Stripe or Google Gemini integrations.
Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Active Budget regarding the Service and supersede all prior agreements and understandings. Your use of Stripe and Google Gemini through the Service is additionally governed by their respective terms and policies, as referenced throughout these Terms.
